TERMS AND CONDITIONS
We draw your attention to the following standard terms and conditions, in particular clauses 6, 7, 8 and 9, which contain provisions defining and limiting our liability in respect of any potential default.
1. PRICE VARIATION - Estimates are based on Webster Printing's current costs of production and, unless otherwise agreed, are subject to amendment at any time after acceptance to meet any rise or fall in such costs. Webster Printing will not be held liable to any price estimated over the telephone. A firm quotation will be given only on sight and receipt of work. Estimates and quotes are valid for a 30 day period, from date given.
2. PRELIMINARY WORK - All work carried out whether experimentally or otherwise at customer's request., shall be charged.
3. COPY - A charge may be made to cover any additional work involved where copy supplied is not clear and legible.
4. PROOFS - Proofs of all work may be submitted for customer's approval and Webster Printing shall incur no liability for any errors not corrected by the customer in proofs so submitted. Customer's alterations and additional proofs necessitated thereby shall be charged extra. When style, type or layout is left to Webster Printing's judgement, changes therefrom made by the customer shall be charged extra. Any client that is shown a proof and fails to see and correct an error has accepted that error on his or her work and can under no circumstances disclaim payment.
5. COLLECTION AND PAYMENT - Payment in full is due when the order is placed.
6. BEST ENDEAVOURS CLAUSE - Webster Printing will use their best. endeavours to secure delivery of the goods on the estimated delivery dates from time to time furnished, but they do not guarantee time of delivery, nor shall they be liable for any damage or claims of any kind in respect of delay in delivery due to unforeseen circumstances.
7. SALE OF GOODS - Ownership of the goods which are subject of this contract shall not pass to the buyer until they are fully paid for, but the risk in the goods shall be borne by the buyer from the date of the delivery.
8. CLAIMS - All claims must. be made in writing to Webster Printing within 7 days of delivery. Webster Printing shall not be liable in respect of any claim unless the aforementioned requirement has been compiled with except in that, a, it was not possible to comply with the requirements and b, advice (where required) was given and the claim made as soon as reasonably possible.
9. LIABILITY - Webster Printing shall not be liable for indirect or consequential loss to the customer arising from third party claims occasioned by errors in carrying out the work or by delay in delivery.
10. STANDARD MATERIAL - Metal, film, glass and other materials owned by Webster Printing and used by them in the production of type, plates, moulds, stereotypes, electrotypes, film-setting, negatives and the like shall remain Webster Printing's exclusive property. Such items when supplied by the customer shall remain the customer' s property.
11. CUSTOMER'S PROPERTY AND PROPERTY SUPPLIED - i, Customer's property and all property supplied to Webster Printing by, or on behalf of the customer will be held at the customer's risk. ii, Every care will be taken to secure the best results where material or equipment are supplied to Webster Printing by customers, but responsibility will not be accepted for imperfect work caused by defects in, or unsuitability of, such materials or equipment. iii, Where the customer supplies materials adequate quantities shall be supplied to cover spoilage.
12. ILLEGAL MATTERS - Webster Printing shall not be required to print any matter which in their opinion is, or may be, of an illegal or liable nature or an infringement of the propriety or other rights of any third party. Webster Printing shall be indemnified by the customer in respect of any liable matter or any infringement of copyright, patent, design or any other proprietary or personal rights contained in any material printed for the customer. The indemnity shall extend to any amounts paid on a lawyer's advice in settlement of any claim.
13. QUALITY - Should extra plates be used due to poor customer supplied artwork, an additional charge will be made; this will also apply if the artist has to carry out work on poor quality artwork (customer supplied).
14. CLAUSE LIMITED PRE-CONTRACTUAL MATTERS - In entering into this contract the purchaser hereby acknowledges that the contract has not been induced by any representation orally or in writing by Webster Printing, and their employees.
15. All orders taken are in good faith, Webster Printing shall not be held responsible for failure of registration by the customer with the local authority.
